1. Agreement to Terms

By accessing or using SalaryApp ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms are governed by Australian law, specifically the laws of the State of Victoria.

2. Service Description

SalaryApp is a salary tracking and estimation tool designed for Australian workers. The Service allows you to:

• Track work shifts and hours
• Calculate estimated earnings
• Estimate tax obligations
• Track leave accrual
• Calculate superannuation contributions
• Estimate HECS/HELP repayments

All financial calculations are performed locally on your device. Your salary data is never transmitted to our servers.

3. Account Terms

You must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Subscription Terms

4.1 Free Trial

New users receive a 7-day free trial with full access to Pro features. No payment is required during the trial. You may cancel at any time during the trial without charge.

4.2 Paid Subscriptions

We offer the following subscription options:

• Monthly: Billed monthly, cancel anytime
• Annual: Billed annually at a discounted rate
• Founding Member: One-time lifetime access

4.3 Automatic Renewal

4.4 Price Changes

We may change subscription prices with 30 days' notice. Price changes will not affect your current billing period. Founding Member pricing is locked at the time of purchase.

5. Cooling Off Period

To exercise your cooling off rights, contact us at support@getanibble.com.au within 14 days of purchase.

6. Cancellation and Refunds

6.1 How to Cancel

• Go to Settings > Subscription > Cancel Subscription
• Or email support@getanibble.com.au

6.2 Refund Policy

• Free Trial: No charge, no refund needed
• Monthly: No refunds for partial months
• Annual: Pro-rata refund available (see Refund Policy)
• Founding Member: 30-day money-back guarantee

6.3 After Cancellation

Your access continues until the end of your current billing period. After that, you'll retain access to free features only. Your locally stored data remains on your device.

7. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

• The Service is provided "as is" without warranties of any kind
• We do not guarantee the accuracy of any calculations or estimates
• We are not liable for any financial decisions made based on the Service
• Our total liability is limited to the amount paid for the Service in the 12 months prior to the claim

Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded or limited.

8. Disclaimers

8.1 Not Financial Advice

The Service provides general information only and does not constitute personal financial advice. We do not hold an Australian Financial Services Licence (AFSL). For personal financial advice, consult a licensed financial adviser. You can find registered advisers at ASIC's Financial Advisers Register.

8.2 Not Tax Advice

We are not registered tax agents. Tax calculations are estimates based on published ATO rates and are for informational purposes only. Do not rely on these estimates for tax returns or financial decisions. For tax advice, consult a registered tax agent. Find one at the Tax Practitioners Board.

8.3 Calculation Accuracy

While we strive for accuracy, calculations may not account for your individual circumstances including:

• Medicare Levy Surcharge
• Private health insurance rebates
• Tax offsets and deductions
• Multiple employers
• Foreign income
• Trust distributions

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Reverse engineer, decompile, or disassemble the Service
• Share your account credentials with others
• Use the Service to provide services to third parties without authorisation
• Automate access or scrape data from the Service

10. Intellectual Property

All content, features, and functionality of the Service are owned by Get A Nibble Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws.

Your data remains your property. You grant us a limited licence to store and process your account data solely to provide the Service.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

• Posting a notice in the app
• Sending an email to your registered address
• Updating the "Last updated" date above

Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
